IMPORTANT : Only one person can subscribe by home, IP (Internet provider) and e-mail address. If any of these conditions is not met iPoints Canada reserves the right to delete accounts.

Rules

These rules and conditions apply to all IPOINTS CANADA program members:

1. General Conditions

1.1. The IPOINTS CANADA points program established by www.iPointscanada.ca (therefore “Distribution Michel Grondin Inc.”) is for Canadian residents aged 18 years and older. Distribution Michel Grondin Inc. has the right to require proof of age and residence at any time, namely prior to issuing a reward.

1.2.
You are not eligible for the IPOINTS CANADA program if you are: an employee of Distribution Michel Grondin Inc., its affiliates or reward suppliers, a member of the immediate family (mother, father, brother, sister, son, daughter or spouse) or a member of their household.

1.3.
To become a member of the IPOINTS CANADA program, you must register in the IPOINTS CANADA section of the www.iPointscanada.ca site.

1.4.
When you become a member of the IPOINTS CANADA program, you free and release Distribution Michel Grondin Inc., its affiliates, associates, employees, agents and representatives who are beneficially interested and respective assignees of all responsibility linked to the IPOINTS CANADA program or, if applicable, any reward acquired in the framework of the program.

1.5.
By becoming a member of the IPOINTS CANADA program, you authorize the organizers to use, if required, your name, picture, place of residence, voice and/or image for publicity purposes without receiving any compensation.

1.6.
Without reducing the generality of the foregoing, the releasees cannot be held responsible for errors or omissions relating to the IPOINTS CANADA program, lost alphanumeric codes or their illegal use.

1.7.
Without restricting the generality of the foregoing, the releasees cannot be held responsible for any incomplete or erroneous information stemming from the users of the site or the IPOINTS CANADA program, the computer equipment or program used for the entire IPOINTS CANADA program or a technical or human error that could occur during e-mail processing, theft, loss or illegal access to your registration, all e-mail sent or corrupted, technical incidents or problems concerning telephone lines or networks, online information systems, servers or providers, computer equipment and software, viruses or bugs, Distribution Michel Grondin Inc. or its representatives’ inability to act, for any reason, for example: Internet or Web site congestion or both, receiving or sending e-mail, damage caused to the member or any other person’s computer system by the participation material or downloading the IPOINTS CANADA program.

1.8. Failure to respect these rules, violation, fraud or excess in the framework of the IPOINTS CANADA program may result in the cancellation of all of a member’s points or the closing of the member’s IPOINTS CANADA account, at Distribution Michel Grondin Inc. or its representatives’ sole discretion. All action taken in this regard shall be final and irrevocable. Under no circumstances can Distribution Michel Grondin Inc. be held responsible for damage, loss or injury resulting from the initiated recourse.

1.9. When events beyond its control adversely affect the smooth operation of the IPOINTS CANADA program, Distribution Michel Grondin Inc. or its representatives reserve the right to initiate any recourse deemed adequate, namely to freeze the points in a member’s account or remove the acquired rewards. The concerned members will be notified of the initiated recourse by e-mail when possible. All action taken in this regard shall be final and irrevocable. Under no circumstances can Distribution Michel Grondin Inc. be held responsible for damage, loss or injury resulting from the initiated recourse.

1.10. Distribution Michel Grondin Inc. reserves the right to end the IPOINTS CANADA program at any time without notice. In this event, members cannot claim compensation for unused points. IPoints Canada can ask at any time to its members to liquidate their points.

1.11. The IPOINTS CANADA program can be modified without notice, including the addition or removal of any IPOINTS CANADA partners.

1.12. The IPOINTS CANADA program is void where prohibited by federal, provincial or municipal law.

1.13. Under no circumstances can Distribution Michel Grondin Inc. be held responsible for any tax consequences that may result from joining the IPOINTS CANADA program.

2. Registration

2.1. When you become a member of the IPOINTS CANADA program, Distribution Michel Grondin Inc. authorizes you to accumulate IPOINTS CANADA points from the different businesses participating in the IPOINTS CANADA program (see list of participating businesses) and according to other methods explained in detail in the manifests and/or on the www.iPointscanada.ca site and exchange them for available rewards in the list of IPOINTS CANADA gifts.

2.2. By becoming a member of the IPOINTS CANADA program, you acknowledge and agree to respect these requirements and agree to allow your personal information to be used according to Distribution Michel Grondin Inc.’s policy on the protection of personal information and its privacy statement, subject to certain requirements exclusive to the IPOINTS CANADA program.

2.3. Registering for the IPOINTS CANADA program is done individually. The name on the account must be the member’s legal name. One registration per person by residence. A single valid e-mail address and a single home address must be provided upon registering. Distribution Michel Grondin inc. reserves the right to disregard all additional entries. The owner of the e-mail address indicated on the registration date is the person to whom an e-mail address was provided by an Internet service provider, an online service provider or another service in charge of assigning e-mail addresses for the domain attached to said e-mail address. Members may be required to submit proof that they own the e-mail address entered during registration.

2.4. Upon registering, you agree to provide accurate and updated information and, if necessary, to quickly update this information to ensure that it is always accurate and complete. You agree to keep confidential any password you choose or are assigned following your registration in the IPOINTS CANADA section of the www.iPointscanada.ca site. You agree to bear responsibility for all actions that stem from the use of this password.

You agree to notify Distribution Michel Grondin Inc. of any unauthorized use of your password. Distribution Michel Grondin Inc. cannot be held responsible for any loss or damage incurred by the failure to respect this clause.

2.5. Members are responsible for notifying Distribution Michel Grondin Inc. of any change of e-mail or home address. Distribution Michel Grondin Inc. cannot be held responsible for incorrectly addressed mail or the consequences of this.

2.6. Members must enter their username and password each time they want to compile their points on the www.iPointscanada.ca site.

3. Accumulating Points

3.1. IPOINTS CANADA cards shall be issued by the businesses participating in the IPOINT CANADA program (according to the policies of each participating business) (see list of participating businesses) and according to the other methods described herein and/or offered on the www.iPointscanada.ca site.

3.2. The alphanumeric code determines the number of allotted IPOINTS CANADA points. Once the code is approved and the points are issued, the alphanumeric code becomes inactive and void.

3.3. Cardholders may enter a maximum of 30 alphanumeric codes per day.

3.4. You can become a member of the IPOINTS CANADA program and acquire points (no purchase required) from participating businesses. Here is how to proceed: Send an original handwritten text (no photocopies will be accepted) stating why you would like to receive an IPOINTS CANADA card for a value of 100 points. There is a limit of one letter per person per day (minimum 100 words) and the text must be different each time. The following information must be included: last name, first name, date of birth, complete address, telephone number and e-mail address. Send the text to the following address:

Upon receipt and acceptance of the text, Distribution Michel Grondin Inc. will give you a code that you can enter on the www.iPointscanada.ca site to obtain your points. Distribution Michel Grondin Inc. has 5 weeks to answer your request.

3.5. We advise you to keep all of your IPOINTS CANADA cards in the event of a problem with your account. If, after entering your alphanumeric code, you notice a difference in the number of points usually in your account, contact DISTRIBUTION MICHEL GRONDIN INC.’s Customer Service at servicealaclientele@concourscanada.ca within 7 days of the code’s entry. You will receive an answer within 90 days of the date we receive your e-mail.

3.6. Distribution Michel Grondin Inc. disclaims all responsibility for unclaimed and unused points.

4. Exchanging or Betting Points– General Conditions

4.1. When you exchange or bet IPOINTS CANADA points, the number of points you need to receive a chosen reward will be subtracted from your IPOINTS CANADA account.

4.2. IPOINTS CANADA points cannot be transferred from one account to another and can only be used for your own gain. Furthermore, IPOINTS CANADA points cannot be moved from one program to another. For example: you cannot change your Promotion iPoints into Consumer iPoints.

4.3. IPOINTS CANADA points are counted as operating units. They have no monetary value and cannot be converted into cash for any item other than the articles on the list of IPOINTS CANADA products.

4.4. You cannot purchase the missing points needed to obtain a desired reward.

5. Exchanging Points – List of IPOINTS CANADA Products

5.1. With regard to what is set out in clause 5.2, all IPOINTS CANADA program members can request a reward from the list of IPOINTS CANADA products displayed on the www.iPointscanada.ca site provided they have enough points in their account and provided that these points are available.


5.2. The rewards on the list of IPOINTS CANADA products are in limited quantities and shall be offered to members according to the date and time they request these items. Distribution Michel Grondin Inc. shall issue the rewards in the order the requests are received. This decision shall be final and irrevocable.

5.3. Under no circumstances or pretence can Distribution Michel Grondin Inc. be required to exchange more rewards than the quantity displayed in the list of IPOINTS CANADA products on the www.iPointscanada.ca site.

6. IPOINTS CANADA Rewards

6.1. The pictures of the rewards are solely for informative purposes regarding value. Rewards will be sent by mail as a gift, gift certificate, ticket or prepaid card for the value of the reward that you have selected. However, if you request a reward in points, these will added to your account.
Note: If you have requested your reward as a card or gift certificate, the retailer may charge taxes when you redeem these in store. You can choose another item of your choice for the same value as the card or gift certificate or pay the difference.

6.2.
Rewards may differ from the picture or illustration displayed on the IPOINTS CANADA site.

6.3.
Rewards cannot be changed and must be accepted as they are, with no possibility of replacement. Distribution Michel Grondin Inc. reserves the right to change one reward for another of the same value if the reward cannot be issued as mentioned.

6.4. If the reward is or involves an event, Distribution Michel Grondin Inc. cannot be held responsible if weather conditions, the event’s cancellation or other causes beyond Distribution Michel Grondin Inc.’s control prevent the latter from giving a reward or part of a reward. Under these circumstances, the member shall not receive a compensatory reward or a cash replacement.

6.5. Distribution Michel Grondin Inc. is not responsible for loss, damage, defect, injury, death, expense or any other problem related to any reward or stemming from its use.

6.6. Before issuing a reward, Distribution Michel Grondin Inc. will ask the member to sign a release and reward acceptance letter. Distribution Michel Grondin Inc. will send the member an e-mail containing a link to the IPOINTS CANADA site where the form can be found. The member must click on the “I accept” button. The reward will not be shipped until this step has been completed.

Distribution Michel Grondin Inc. may also require a signature on the delivery slip for certain rewards. Example: a costly reward (trip, gift certificate valued at $200 or more). The reward will be considered duly delivered once the delivery slip is signed, regardless of the identity of the person who signs. Distribution Michel Grondin Inc. will no longer be responsible for the reward once a signature is obtained.


CONTEST

1. The contest is held on the IPOINTS CANADA site.

ELIGIBILITY

2. This contest is open to all Canadian residents aged 18 years and older, excluding IPOINTS CANADA employees, agents and representatives, their sponsors, reward and material suppliers and service providers related to the contest as well as any person in their household.

HOW TO PARTICIPATE

3. To participate in the "IPOINTS CANADA Cards" contest, you must access the following URL address while the contest is being held: http://www.iPointscanada.ca, be registered as a member of IPOINTS CANADA and have accumulated IPOINTS CANADA points on the www.iPointscanada.ca site.

Contest begins: November 25, 2005
Contest ends: November 24, 2010

You can become a member of the IPOINTS CANADA program and acquire points (no purchase required) from participating businesses. DRAWING


4. A drawing among all of the members who have accumulated IPOINTS CANADA points on the www.iPointscanada.ca site will take place at 9:00 a.m. on the date indicated on the prize sheet. A total of one (1) winner will be selected during this drawing. Once the winner has been determined, the other entries become void. To be eligible for the next drawing, you must accumulate new IPOINTS CANADA points.

5. The winner will receive his/her prize in the mail. However, if the prize is in points, these points will be added to the winner’s IPOINTS CANADA account. IPOINTS CANADA has 30 days after the day of the drawing to ship your prize.

6. For the purpose of this rule, the participant is the person whose name appears on the registration form. This person will receive the prize, if applicable.

GENERAL CONDITIONS

7. All electronic registration is subject to verification by the contest’s organizers. Incomplete or fraudulent registration will automatically be rejected and the person will not be entitled to a prize. In this event, the organizers will draw another name. Decisions made by the organizers to this effect are final and not open to review.

8. The prize must be accepted as issued and cannot be transferred, substituted for another prize or exchanged in whole or in part for cash. If, for reasons unrelated to the winner and beyond the organizers’ control, they are unable to issue a prize as described in this rule, they reserve the right to issue a prize of the same nature and of equivalent value or, at their absolute discretion, the value of the prize in cash.

9. By participating in this contest, the winner authorizes the contest’s organizers to use, if required, his/her name, picture, place of residence, voice and/or image for publicity purposes without receiving any compensation.

10. The contest’s organizers disclaim all responsibility related to the malfunction of any computer component, software or communication line, the loss or absence of networked communication or faulty, incomplete, incomprehensible or erased transmission by any computer or network that can limit the possibility or prevent any person from participating in the contest. The contest’s organizers disclaim all responsibility for any damage or loss, in whole or in part that could be caused, directly or indirectly, in whole or in part, by downloading any software or forms and by sending any information in order to participate in the contest.

11. Subject to approval by the Régie des alcools, des courses et des jeux du Québec, the contest’s organizers reserve the right, at their absolute discretion, to cancel, end or suspend this contest in its entirety in the event of a virus, computer bug, unauthorized human intervention or any other cause beyond the organizers’ control that could corrupt or affect the contest’s administration, security, impartiality or normal progression.

12. Participation in the contest is considered acceptance of the rules of said contest.

13. Subject to all applicable federal, provincial and municipal laws and regulations, these rules govern all of the contest’s aspects and bind all participants.

14. In Quebec and Canada, a dispute involving the organization or operation of a promotional contest can be submitted to the Régie des alcools, des courses et des jeux for settlement. A dispute about the allocation of a prize can be submitted to the Régie solely for the purposes of an intervention in order to attempt to settle the dispute.
